This is surely just getting ridiculous now!

How can there be a law against braking or slowing down? And yet there are reports that anti-braking cameras might be deployed in the UK.

    This sounds like a cross between a very bad joke with no one laughing at all and a case of ‘Silly Season’!

    For a start, there is no law against excessive braking, certainly not in the Highways Act and the Road Traffic Act. The law permits braking to arrest the momentum of the vehicle to stop safely and avoid damage to vehicles and people, the latter to obviously avoid injury and/or death (my knowledge of this comes from my working in the Met. Police Civil Staff at one time, coupled with my late father’s exemplary service as a Met. Police officer from 1953-1982 with Traffic Division service alone from the 1960’s until his retirement through injury and ill-health, and a very good solicitor friend of mine).

    Any legal professional would have this lunacy shot down in flames in court if they ever tried this on because it would be argued that it is a cynical (and illegal) attempt at financially penalising drivers for carrying out an emergency braking application in a critical traffic incident to avoid collision damage and even a FATACC (pronounced ‘Faytac’, ‘Fatal Accident’ as the Traffic Police term it. My father did a lot of those reports). As you quite rightly mentioned in your reportage, people are taught to do an emergency brake application in driver instruction prior to taking the test and carrying out an Emergency Braking Application as part of aforesaid test.

    I spoke to a Merchant Navy friend of mine (First Mate on a British-built, British-owned and British-registered freighter) and one of his shipmates who is Spanish told him this policy has already been shot down in flames with at least one Spanish sailor allegedly being discharged by a Justicar for acting correctly in trying to avoid an accident. That might not be the only case dismissed from the sound of things but, as they say, ‘watch this space’ (especially if opposition parties kick up a storm too!).

    I’m waiting for the next looney idea here like trying to fine Train Drivers for emergency brake applications on both the national railways and preserved private railways to avoid SPAD (Signal Passed AT Danger) and danger of collision accidents.
